Despues del escándalo al darse cuenta el país que el [proyecto de Ley para sancionar descargas ilegales][3] [estaba redactado con software pirata][2], ahora es el turno del cantante Fernando Ubiergo, cabeza de la SCD., que dió una presentación sobre derechos de autor con una versión de Office que en [mitad de la presentación empezó a quejarse por no ser original][1].

La SCD [busca en Chile algo similar al "canon" español][4]. Es decir, recolectar dinero en base a perjuicios “presuntos” por piratería, perjudicando a los usuarios y beneficiando a los artistas que no venden discos. Como en España, que al comprar un CD virgen, una gran parte del precio es un impuesto que va a la SGAE (SCD en Chile), aún cuando las creaciones en ese CD virgen sean tuyas, sólo por el hecho de que “podría” haberse copiado música de la SGAE allí.

Y no duró nada…

Gracias al (ya conocido) poder de la comunidad virtual y de medios digitales ciudadanos, en el blog de emol cuentan que el proyecto de modificación artículo 81 de la Ley 17.336 ["o se revisa o se retira"][3].

Si bien no fue suficiente para que los electos representantes reconocieran en detalle por qué el proyecto [no tiene ni pies ni cabeza][6], ni se mencionó nada de la situación de derechos de autor [del blog del diputado Insunza][5], o del [software pirata utilizado para redactar la ley][4].

Y aunque la explicación haya sido impresentable como el proyecto mismo, [lleno ambiguedades y contradicciones][1], los ciudadanos tienen para estar orgullosos de que en estos tiempos no es tan fácil pasar cabezas de pescado por encima de la gente ( que tampoco es primera vez… recordemos el [proyecto sobre el spam de Jovino Novoa][8] o el [caso Microsoft][7] ).

Los diputados Guillermo Ceroni, Rodrigo González, Jorge Insunza, Tucapel Jiménez, Marco Antonio Núñez, Jaime Quintana y doña Ximena Vidal, del PPD (excepto Jiménez) [intentan pasar un proyecto de ley][1] para cortar el accesso a Internet a quien haga una “descarga de archivo” ilegal.

>Artículo único: Incorpórese un nuevo inciso final al artículo 81 bis de la Ley 17.336 sobre Propiedad Intelectual, del siguiente tenor:

>“Las personas o abonados que descarguen de Internet archivos que infrinjan las disposiciones de la presente ley, sin perjuicio de las demás penas señaladas, estarán sujetos a la suspensión de su conexión a la red, de entre tres meses y un año.”

## Tristes realidades:

* Los diputados solo copian leyes que [van apareciendo en Europa][3]. Menos mal que dichas leyes no tienen copyright, o les cortarían el acceso a Internet.

* De acuerdo con [evidencia presentada por Fayerwayer][2], Dichos diputados escriben sus leyes con software pirata. Denuncia pendiente en la ADS (Asociación de Distribuidores de Software) contra Guillermo Frêne y el estudio Carey y Cía.? . Invito (y desafío) a los que respaldan esta ley a hacer una denuncia pública contra el estudio de abogados con la ADS.

* Sólo muestra la ignorancia de estos diputados en temas técnicos y su falta de asesoría.

* El término “descarga de archivo” es ambiguo. Si yo usase un browser (navegador) que hiciese pre-caching de todos los elementos de una página, desde el lado del ISP se vería como una descarga de archivo. Desde el lado del usuario es una acción invisible y sólo por motivos técnicos. El usuario no tiene 100% control sobre las acciones que realiza el software.

* Si un usuario viera en una página un archivo llamado “cancion de dominio publico.mp3″ y al descargarla esta fuera en realidad una canción de Fernando Ubiergo, el usuario habrá descargado (desde el punto de vista del proveedor de Internet) un archivo ilegal. El usuario no tiene modo de saber a priori que esta descargando, y para evaluar si algo es legal o no, muchas veces debe primero descargarlo.

* El diputado Jorge Insunza viola la ley de propiedad intelectual en su blog, [reproduciendo más de 10 líneas de la obra Nieve, de Orhan Pamuk][4]. Invito (y desafío) a los que respaldan esta ley a hacer una denuncia pública contra Jorge Insunza.

* (Así mismo, cualquier ciudadano que hubiese entrado al blog de Insunza, de haber estado en vigencia la absurda ley, habría incurrido en una falta, ya que abrir una página en el navegador es técnicamente una descarga de archivo).

* El proveedor de Internet no tiene como saber que si un archivo descargado (por ejemplo un archivo mp3) es legal o ilegal, pues ello depende de si el usuario posee el original en casa (el CD por ejemplo).

I agree with [Robert Reich][1]. A free market needs that companies can fail.

[FP][1] is running an article called [Europe’s Philosophy of Failure][1]. Citing the summary to give you an idea:

Taught that economic principles such as capitalism, free markets, and entrepreneurship are savage, unhealthy, and immoral, these children are raised on a diet of prejudice and bias. Rooting it out may determine whether Europe’s economies prosper or continue to be left behind.

I don’t want to make a flame on economical systems, models, and so on. But I like to comment on propaganda.

Since I moved to Europe, I have spend lot of time observing the society and comparing (Denken heißt vergleichen) it to what I saw in Chile and what I see from other cultures like the United States. I can’t include Asia in the mix because I know really little.

I think in Europe there is a left wing bias in almost everything. You start to see it in small details that create contradictions in your head, like advocating free speech on one hand as long as it is not right wing ideas (which are called for censorship or “anti” manifestations ). Countries like Belgium, which from one side talks about human rights, but then gives asylum, passports and money to murders from Chile or Spain terrorist groups, just because they are left wing, which upgrades them from murders to “politically prosecuted”. Those are extreme examples.

In the normal day to day life, this left-wing bias will of course end up in education and the way the economy works. However, I think this bias is not bad at all. It is just different. Let’s look at the article’s points:

Which other Western countries apart of USA (and may be UK)?

[More taxes for rich people, and fewer for wealthy corporations][4] is something even the Gates support.

I don’t think Europe’s attitude on globalization is bad at all. I think it focuses in very basic aspects:

* If production is going to be moved to third world, lower salaries there is something you expect, but not everyone expect children to build the products.

* If one continent cares about the environment and the other does not. Is it globalization anymore? is it fair competition to do it under different moral views?

So the problem on how “capitalism” is being advocated (even if it is there already in almost every country) is surreal. There is no such things as pure free market. Europe may want to protect certain market from unfair competition. How is this different (from the economical point of view) from using military power for oil?

[This post is worth to read][5], and its conclusion:

>Comparing the economic performance of the European Union and the USA does not lead one to conclude that America has the more dynamic economy, or that it has performed better in the past or will do so in future. The most important feature of the comparison is neither the growth nor the unemployment record of the US and the EU. It is, rather, that US growth, unlike that in the EU, is funded by a dangerously high mountain of foreign debt. US external indebtedness, in turn, is driven by the US house-price bubble, enabling US consumers to spend more than they earn. Ironically, it is the EU which, together with China and Japan, continues to lend the money to the US which keeps their households spending and their economy growing.

And some of the comments just make the whole point:

So please guys. Let accept there are two different models. But I don’t think doing propaganda on the false basis that one performs better than the other.

Some random thoughts about the world, and the past and following years.

### Digital society

2007 was quite active on the digital rights topic.

The inability of the industry to catch up with the current society has created a war on digital rights. Software patents on one side. Digital music transformed music labels into mafias and consumers into rival groups. Politicians trying to implement surveillance systems everywhere.

I have the feeling that we will see some progress on the music topic. Record labels will give up, but it will be too late, and if a bunch of major artists start to use some fair system. Something like amiestreet.com or direct selling comes to my mind.

I don’t think something will happen on patents.

It was funny, some weeks ago I got an idea about using gps to associate location to todo items. This plays well with the getting things done methodology where you organize by contexts and not categories. I started prototyping some stuff on android.

Sadly, I found out this simple idea [was patented][gps-todo-patent] by Fujitsu. Not only that. But I found [a program][naggie] which does that, and the website dissapeared. [Another news][place-mail] article about someone researching on the topic and developing a product on that also dissapeared from the map. However, I haven’t yet seen a product from Fujitsu on the topic (the patent is 7 years old). Software patents destroy innovation. Thanks to that stupid patent, you won’t see any product (unless free software) using that.

### The web 2.0

Everybody is sick of the Web 2.0 buzz. The Web 2.0 exists.

It is normal that consultants/analysts start to invent new terms because their business depends on the next “big thing” that will “cut costs” and “save millions” to your company. They repeat the same year after year just replacing the term itself.

However the amount of services on the web is growing really fast, and they are all accessible by really standard protocols. Software is becoming just a support medium and the value is being transfered to services: information, storage, security, etc.

Now, there are new layers over that. Phones with [gps][wikipedia-gps] will bring a new dimension of services based on our location. This is very important. The information we store on the web becomes more relevant if we map it over real-world dimensions: location, time, mood, energy, context. Open source fits here, you can see companies like Google taking advantage of it.

*Question*: How services will affect open source and/or free software itself? Google contributes quite a lot to open source software. But once you don’t distribute the software, you are not forced to publish modifications. Will other companies follow this path?

[Amazon Web Services][aws] is another topic. The way they sell on demand “computing power”, “human processing”, “databases” and “storage” is simply amazing.

I would like to see more about “distributed” environments. I am disappointed on how I have to manage my information having 3 computers and one cell phone. There has to be something better than either being off-line and centralized or being online and ubiquitous (where network is available). I want to be ubiquitous, distributed, fail tolerant, and in a simple, pragmatic way. (I don’t want to setup a cluster on my devices).

What about the bubble?. Yes, there is a bubble. There are a bunch of companies that know what they are doing. And thousands of venture capital groups funding whoolalalhzuzu.com ajax websites which implement a calculator or whatever. Those dying is not a bubble, it is natural selection. Most people already know which ones will die after using them for 2 minutes.

I am really excited about the developments in this area and looking forward what is coming here. The direction is clear.

### Software

+ openSUSE / YaST

+ KDE 4.0

4.0 is being released in a few days and you will see the most brave release of free software ever. A big bunch of new technologies and visions collected, cooked and packed inside a great community. And better, there is still no big place for politics in KDE, but technical arguments and user experience. Not that all desktops could say the same.

### Software Development

Wow, what happened on 2007?

* Software configuration / Version Control

The growing complexity of open source codebases, plus the need to maintain them for enterprise purposes, brought the topic of version control really hard on the blog sphere. Every blog and developer talked about [git][git]. Lot of talk about mercurial and bzr too. 3 version control systems being popular at the same time? The point is that being “distributed” is “the thing”. I personally switched to git, and it solved the “being distributed” part of working with 3 computers in different places. I want to see something like code.google.com with git support.

* Android

Brilliant. I am waiting for the first phone. Some APIs are ugly. But still prettier than [uggly guys][rim] that [reinvent the wheel poorly][bberry-jde], and worse, only on Windows.

Nothing that spectacular on other old topics:

* Java

While Eclipse is a jewel. Sun is getting better but too slow to move. So slow that it is getting boring to watch.

* Ruby

We saw the release of ruby 1.9 on December, a very important milestone. At the same time, JRuby is now fast and very compatible, and other implementations are also very active.

* C++

Even more boring than Java eh?

### Politics

* Chile

The goverment of [Michelle Bachelet][bachelet] whose goverment improvisation has made the country again miss the opportunity to develop quickly. Michelle has no strategy at all, so the hope for 2008 is that his sucking team don’t make more mistakes. The public transport system ( [Transantiago][transantiago] ) has to start working somehow (both in operation and budget), because till now, it is a joke.

The opposition hasn’t a good alternative. Nobody is willing to make the important change: universal *free* and _good_ education, health and social care. Even Michelle, being a socialist, uses the private health and education system.

* Europa

Spain’s election coming. Seems that Zapatero will be reelected, which seems reasonable. I am a little lost with german politics and I feel like living in a fantasy world. Time to change that. Still, Europe’s economy is going good and living here is awesome. I love it.

* USA

Discussions on whether they should teach [non-science][id] on science class?. War. etc. Uhm… was I writing about a middle west country? I am sad, really sad to see a beautiful country being destroyed, destroying, hating and being hated by almost the entire world, and even worse, considered the biggest threat to the rest of the world.

Paralelamente a la Cumbre Iberoamericana, organizaciones de izquierda [organizan un evento llamado Cumbre de los Pueblos][1].

No pude evitar reirme con este comentario:

Ahora ya no es presidente solamente. Sino que es necesario recalcar que es un presidente “constitucional”. Veremos que relación tuvo Allende con la Constitución:

Luego, veamos que dijo la [cámara de diputados en esa época sobre Allende][2] y la constitución:

>El Acuerdo, aprobado por casi dos tercios de los diputados (63.3%), acusaba al gobierno del Presidente Allende de veinte violaciones concretas a la Constitución y las leyes, entre las cuales destacaban amparar grupos armados, torturar, detener personas ilegalmente, amordazar la prensa, manipular la educación, limitar la posibilidad de salir del país, confiscar la propiedad privada, formar organismos sediciosos, violar las atribuciones del Poder judicial, el Congreso y la Contraloría, y todo ello de manera sistemática y con el fin de instaurar en Chile “un sistema totalitario”, es decir, una dictadura comunista.

Aparte de salir electo gracias a un acuerdo “especial” que no respetó, y de limpiarse el trasero con ella, no hay otra relación entre el presidente Allende y la Constitución. Asi como no hay relación alguna entre la extrema izquierda Chilena, incluyendo al PC, una sección del PS, Lautaristas, gente del Frente con un Chile democrático. Cualquier comentario que ellos reciben en este sentido se confronta utilizando a Pinochet. Los crímenes del gobierno militar se han usado para canonizar a la extrema izquierda Chilena, e incluso hacer caso omiso cuando se llenan la boca hablando de democracia.

Estoy hasta los huevos de escuchar a incongruentes izquierdistas hablar de democracia, llevar a ese dictador a ser una figura con estatua EN LA PLAZA DE LA CONSTITUCIÓN!!, con una plaza llevando su nombre en cada ciudad Europea y llamando a sus cobardes héroes (asaltantes de bancos, y asesinos) “prisioneros políticos”, los cuales son [defendidos y protegidos][4] por el cobarde gobierno que nuestro país tiene ahora, con una incongruencia ideológica sin límites.

Hoy hasta los textos escolares de mi país estan manipulados para convencer al mundo de que este tipo es un ejemplo. Por supuesto jamás se le va a mostrar sus violaciones a la constitución, las [acusaciones de racismo y antisemitismo que se le imputan][2].

No, no me saquen a Pinochet en los comentarios, que Pinochet también me dejó hasta los huevos. Y utilizar A para defender B, lo indefendible, también.

Mientras que en Chile, [4 historiadores critican][1] el sesgo de las modificaciones al curriculum de Ciencias Sociales que tienen que ver con la historia reciente, pasando propaganda de la Concertación por debajo, en España la [discusión es en torno a la asignatura Educación para la Ciudadanía][2], sobre la cual la extrema derecha española ha publicado una serie extractos. Las críticas no tienen sentido en algunos casos, pero en otros, el texto no es para la risa, y muestra también sesgos políticos y propaganda.

Es una pena que los intentos de modernizar la educación, terminen en propaganda política de izquierda.

Las malas ideas se copian. A través de [Fayerwayer][1], vía [quemarlasnaves.net][3] me entero de que la Sociedad Chilena de Derecho de Autor quiere que en Chile exista [Canon por copia privada][2], o sea un impuesto a todos los medios de grabación, aunque los uses con fines legales y privados, para llenarles sus bolsillos. Una copia del rídiculo impuesto que se aplica en España, y que hace que medos de grabación y reproducción sean mucho más caros.

Aún no aparece mucho sobre el tema, por lo que me limito a comentar un párrafo:

Las licencias no se han inventado para estar de acuerdo o no con ellas. La licencia solo puede ser elegida por el dueño del copyright de un trabajo. El dueño puede hacer lo que quiera con su obra y licenciarla bajo los términos que le parezcan. Las licencias son sólo plantillas para ayudar a licenciar obras bajo los términos más populares entre la gente que no quiere licenciar bajo “Todos los derechos reservados” sino “Algunos derechos reservados”.

Me gustaría saber, ¿Qué parlamentarios están apoyando esto?
